Visa services

Partner Visas

Partner visas allow the spouse or de facto partner of an Australian citizen, permanent resident or eligible New Zealand citizen to live in Australia.

Who this is for

  • Married partners of Australian citizens, permanent residents or eligible New Zealand citizens
  • De facto partners, including same-sex couples
  • People engaged to an eligible Australian sponsor who plan to marry in Australia

How this pathway works

Partner visas are generally granted in two stages: a temporary visa first, then a permanent visa after eligibility is assessed again. Different subclasses apply depending on whether you apply in or outside Australia.

Applications rely heavily on evidence that your relationship is genuine and continuing, across areas such as finances, your household, social recognition and your commitment to each other. Your partner must also be approved as your sponsor.

Key considerations

  • Whether to apply in or outside Australia
  • Meeting de facto relationship requirements, or an exception such as a registered relationship
  • The strength and consistency of your relationship evidence
  • Sponsor eligibility, including limits on previous sponsorships
  • Significant government application charges

Typical documents

Every case is different. These are documents commonly needed for this type of application; your own checklist depends on the visa and your circumstances.

  • Passports and identity documents for both partners
  • Marriage certificate or evidence of your de facto relationship
  • Evidence of shared finances and household
  • Statements from friends and family about your relationship
  • Communication and travel history
  • Police certificates and health examinations

What the consultation involves

  • A review of your background, goals and timeframe
  • An explanation of the visa options that may be available, and their pros and cons
  • The key requirements and risks to consider for your situation
  • The documents you are likely to need
  • Fees and next steps, confirmed in writing before any work begins

Frequently asked questions

How long do we need to have been in a relationship?

Requirements differ for married and de facto couples. De facto partners generally need to show they have lived together for at least 12 months before applying, unless an exception applies, such as a registered relationship.

Can we apply if we live in different countries?

Possibly. Couples can live apart for periods, but you will need to explain why and show that your relationship is genuine and continuing.
